Agricultural Tenancies created before 1st September 1995 are governed by the Agricultural Holdings Act 1986. These tenancies can only be terminated in very limited circumstances and it is vital that landlords and tenants take the appropriate legal advice.Generally all tenancies created after 1st September 1995 are Farm Business Tenancies (FBT’s) and governed by different legislation. These tenancies are normally shorter and for a fixed term. It is normally necessary to give the tenant at least 12 months notice to quit. The law relating to agricultural tenancies can be very complicated and it is important to take legal advice if you are considering entering into or terminating such an agreement.
