Powers of Attorney – An Insurance Policy for the Future
A Power of Attorney is a legal document that gives other people of your choosing the legal right to manage your financial affairs and/or make decisions about your health and welfare. Of course, we all hope to retain full physical and mental health until our death, in which case it would never be needed! However, it is likely to be needed if we should have an accident or develop a physical or mental health problem which prevents us from doing such things – and making such decisions – for ourselves. Even the ageing process itself can often mean we are less able to get out to the Bank or speak on the telephone. A Power of Attorney can make life a lot easier! It can also be useful if a prolonged absence from the UK is planned.
A Power of Attorney is particularly important to consider if you have had a recent diagnosis of a progressive illness, such as Parkinsons Disease, Dementia, Multiple Sclerosis or Huntingdons Disease.
Should the worst happen and you do not have a Power of Attorney in place the only recourse would be an application to the Court of Protection to appoint another person to manage your affairs. That person could possibly not be person you would have wanted to be given such rights. Applications to the Court of Protection can often be a costly and lengthy process at a difficult time with significant emotional costs attached to them.
